Finance & security advice for 90MW thermal power plant in Mali

A lender in the construction and operation of a 90MW thermal power plant near the city of Kayes in Mali requested advice on providing a ‘red flag’ summary of each project agreement and finance agreement from a lender’s perspective and specific risks in each document. We made appropriate amendments where relevant to the transaction documentation; and reviewed all of the security agreements. We provided an explanation on the taking, perfection and enforcement of security under Malian/OHADA law, and highlighted the main considerations in Shari’a law transactions generally.
